Condemnation & Property Owner Rights

Metro Atlanta Area Property Condemnation Lawyers

Property condemnation proceedings are a way for the government to secure private property for public use. At Power & Cooper, P.C. in McDonough, Georgia, we represent both the government and the landowners asserting their property owner rights.

Under property condemnation law, there are two methods to secure land. The first method is known as a quick take. In a quick take, the state or local government files a complaint to take the property owners land and immediately takes title to the land.

The other method under property condemnation law is the Special Master Procedure. Under the Special Master Procedure, a hearing is scheduled and both sides present their issues. Property value is determined by the "master" and, if need be, a jury that serves as the final arbiter.

At Power & Cooper, P.C., we have unique qualifications statewide in representing the Department of Transportation, the City of Atlanta and Henry County in condemnation proceedings. Few other firms have that experience and capability, as well as the knowledge of both the property condemnation laws and the Property Owners Bill of Rights.
